Maddern's Place Garden & Landscaping - Terms of Service Agreement

Effective date: May 2023

This Terms of Service Agreement ("Agreement") is entered into by and between the customer ("Customer" or "You") and Maddern's Place Garden & Landscaping, a sole trader ("Company," "We," "Our," or "Us").

SERVICES: We offer a variety of garden and landscaping services ("Services"). The specifics of the services to be provided will be agreed upon before the commencement of work.

CANCELLATIONS: If you need to cancel the agreed-upon Services, please notify us as soon as possible. A cancellation made by the Customer within 24 hours of the scheduled Service will incur a cancellation fee. This is due to the potential loss of work, as it can be challenging to fill these slots at short notice. The cancellation fee will be the lesser of 25% of the total Job price or $50.

PAYMENTS: Payment for the Services is preferred on the day of service completion. However, with prior arrangement, we offer a 24-48 hour turnaround for payments. We accept payments in the form of cash, EFTPOS, or online billing.

LATE PAYMENTS: If payment is not received by the agreed-upon due date, late payment fees may occur. If you foresee a delay in making the payment, please contact us as soon as possible. We are a small business that relies on prompt payment so that we can meet our obligations and continue to provide high-quality services.

UNPAID ACCOUNTS: If unpaid accounts persist, all outstanding invoices may be sent to a recovery agency for collection. The Customer will be responsible for any costs associated with this collection process, including, but not limited to, legal and court fees, as permitted by law.

LIMITATION OF LIABILITY: The Company's total liability for any claim arising out of or relating to the Services will be limited to the amount paid by the Customer for the Services.

GOVERNING LAW: This Agreement will be governed by and construed in accordance with the laws of the jurisdiction in which the Company is located.

ACKNOWLEDGEMENT: By availing our Services, you acknowledge that you have read, understood, and agree to be bound by these terms.

Please note that these terms are subject to change at our discretion. Changes will be notified to you in advance.
